GENERAL TERMS AND CONDITIONS OF USE

These general terms and conditions of use apply to the services provided by the legal entity  DIGTE TECNOLOGIA DA INFORMATION EIRELI, duly registered under CNPJ n.  14.557.916/0001-51, hereinafter referred to as " publisher " with headquarters at:

through the app  Enter Public Form .

1. OBJECT

The application  Enter Public Form  characterized by the provision of the following services:

Digte Public Form , software that enables BPM processes  Fluig platform owned by TOTVS SA, are exposed on public pages. 



2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF USE

All those who wish to have access to the services offered through the app  Digte Public Form must, first, inform themselves about the rules that make up this instrument, which will be available for prompt and wide consultation, in a direct link in the application itself.

When using the app  By entering Public Form , the user fully accepts these rules and undertakes to comply with them, at the risk of applying the applicable penalties. Before starting any navigation in the application, the user must be aware of any modifications or updates occurring in these terms.

If you do not agree with any of the rules described here, the user must immediately refrain from using the service. If it is of interest to you, you can also get in touch with customer service, to present your reservations.



3. NAVIGATION

The application editor  Digte Public Form undertakes to use all technical solutions at its disposal to allow access to the service 24 (twenty four) hours a day, 7 (seven) days a week. However, he may, at any time, interrupt, limit or suspend access to the application or to some of its pages, in order to carry out updates, content modifications or any other action deemed necessary for its proper functioning.

These general terms and conditions of use apply to all application extensions  Digte Public Form on social networks or in communities, both existing and those yet to be implemented.



4. MANAGEMENT  THE APPLICATION

a) suspend, interrupt or limit access to all or part of the application to a specific category of Internet users;

5. REGISTRATION
 

The services available in the app  Digte Public Form can only be accessed by fully capable people, according to Brazilian law. All those who do not have full civil capacity - under 18 years of age not emancipated, prodigal, habitually drunk or addicted to drugs and people who cannot express their will, for transitory or permanent reasons - must be duly assisted by their legal representatives, who are will be responsible for complying with these rules.

The user will be allowed to keep only one account with the application  Enter Public Form . Duplicate accounts will be automatically disabled by the app publisher , without prejudice to other applicable penalties.

For proper registration with the service, the user must provide the required data in full. All information provided by the user must be accurate, true and up to date. In any case, the user will be liable, in civil and criminal terms, for the veracity, accuracy and authenticity of the data provided.

The user must provide a valid email address, through which the application will make all necessary contacts. All communications sent to this address will be considered read by the user, who undertakes, therefore, to regularly consult the messages received and to respond to them within a reasonable time.

After confirming your registration, the user will have a login (nickname) and a personal password, which must be used by him to access his account in the application  Enter Public Form . These connection data may not be communicated by the user to third parties, and the use made of them is entirely the responsibility of the user. The user undertakes to immediately notify the publisher of the application of any suspicious or unexpected activities on his/her account. The account will not be allowed to assign, sell, rent or transfer, in any way. in this instrument, being forbidden to register again in the application.

The user may, at any time and without justification, request the cancellation of their registration with the application  Enter Public Form . Your unsubscribe will be carried out as soon as possible, as long as no outstanding debts are verified.



6. RESPONSIBILITIES

The publisher will be responsible for defects or defects found in the services provided by the application  Enter Public Form , as long as you have given them cause. Defects or technical or operational defects originating in the user's own system will not be the editor's responsibility.

The editor is only responsible for the information that was directly disclosed by him. Any information included by users, such as in comments and personal profiles, will be the sole responsibility of the users.

The user is also responsible:

a) for the correct use of the application and its services, valuing good coexistence, respect and cordiality in the relationship with other users;

b) compliance with the rules contained in this instrument, as well as norms of national and international law;

c) for the protection of the access data to your account (login and password).

The editor will not be responsible:

a) due to the intrinsic characteristics of the internet, mainly related to the reliability and origin of the information circulating in this network;

b) for illegal content or activities carried out through its application.



7. EXTERNAL LINKS

The application  Digte Public Form may contain external links redirecting the user to other internet pages, over which the editor has no control. Despite prior and regular checks carried out by the publisher , he disclaims any responsibility for the content found on these websites and services.

Links may be included on application pages and documents  Digte Public Form , as long as they are not for commercial or advertising purposes. This inclusion will depend on prior permission from the publisher .

The inclusion of pages that disclose any type of illicit, violent, controversial, pornographic, xenophobic, discriminatory or offensive information will not be authorized.



8. COPYRIGHT

The structure of the application  Digte Public Form , as well as texts, graphics, images, photographs, sounds, videos and other computer applications that comprise it are the property of the publisher and are protected by Brazilian and international legislation regarding intellectual property.

Any representation, reproduction, adaptation or partial or total exploitation of the contents, brands and services proposed by the application, by any means whatsoever, without the prior, express and written authorization of the publisher , is strictly prohibited, and civil and criminal measures may be resorted to applicable. Only elements that are expressly designated in the application as free of copyright are excluded from this provision.

Access does not generate for the user any intellectual property rights relating to elements of the application, which remain under the exclusive property of the publisher .

It is forbidden for the user to include in the application data that could modify its content or appearance.



9. PRIVACY POLICY


1. Personal data

All personal data provided by the user at the time  of your registration  or that may be requested later, in this capacity, will remain confidential and will not be passed on to any partners  of the application.

The publisher may only transmit personal data to third parties when the user expressly allows it or when the legal hypotheses provided for in Brazilian law are present, such as a court order.

It is the editor's responsibility to guarantee the confidentiality of personal data provided by users, and must protect  the application  against attempted breaches or clandestine access to its database.


2. Navigation data

The application  it occasionally resorts to "cookies" techniques, which allow it to analyze statistics and information about the user's navigation. For example, data can be provided about the device used by the user and its access location. This collection of information seeks to improve navigation, for the user's comfort, by allowing us to present personalized services, according to their preferences.

11. CHANGES

The present version of the General Terms and Conditions of Use was last updated on:  05/01/2017.

The publisher reserves the right to modify, at any time and without prior notice, the app and the services, as well as these rules, especially to adapt them to the app's evolutions.  Digte Public Form , either by making new features available, or by suppressing or modifying existing ones.



12. APPLICABLE LAW AND JURISDICTION

For the settlement of disputes arising from this instrument, Brazilian law will be fully applied.

Any disputes must be filed in the court in which the publisher of the application is located.
